ACT Computers – Terms and Conditions

1. Who we are and what these terms cover

These terms apply to all goods sold, repairs done and services provided by ACT Computers Kroonstad Head Office CC (registration 1988/031465/23, VAT 4050116286), 36 President Street, Kroonstad, 9499 (“ACT Computers”, “we”), from 1 November 2026. By ordering goods, booking a repair or using our services, the customer accepts these terms.

Where the customer is a consumer, nothing in these terms takes away rights under the Consumer Protection Act 68 of 2008 (CPA). Internet services are provided separately by ACT ISP Services CC under its own terms.

2. Repairs

  1. Job card. Every device booked in gets a job card listing the device, its condition, accessories handed in and the fault reported. The customer must keep the job card to collect the device.
  2. Diagnosis and quote. We will give the customer a written quote (by job card, SMS, WhatsApp or e-mail) before any repair is done. A diagnostic fee, shown on the job card, is payable if the customer declines the quote; it is included in the repair price if the quote is accepted.
  3. Approval. No repair is done without the customer’s approval of the quote. If further faults are found, we will ask for approval again before going over the approved amount.
  4. Data and backups. Repairs can result in loss of data. The customer is responsible for backing up all data, software and settings before handing in a device. ACT Computers is not liable for any loss of data, unless caused by our gross negligence.
  5. Passwords. The customer must give us any passwords or PINs needed to test the device, or the repair may not be fully tested.
  6. Parts. We may use new or reconditioned parts of equal quality. Replaced parts are returned to the customer on request at collection, except parts exchanged under a supplier warranty.
  7. Devices that cannot be repaired. If a repair is not possible or not worth it, we will tell the customer and only the diagnostic fee is payable.
  8. Previous tampering. Devices opened, liquid-damaged or repaired elsewhere may have hidden damage. We will explain any extra risk before the repair.

3. Warranty

Applies to Warranty
New goods 6 months against defects (CPA), or the manufacturer’s warranty if longer
Repairs 3 months on the parts fitted and the labour for that repair (CPA)
Second-hand or refurbished goods 6 months (CPA), except for a defect we disclosed in writing on the invoice and the customer accepted
  1. A warranty claim must be made with the invoice or job card.
  2. If goods are defective, the customer may choose a repair, replacement or refund, as the CPA allows. Where the manufacturer’s warranty applies, we may send the goods to the manufacturer or its agent.
  3. The warranty does not cover damage from misuse, accidents, drops, liquid, lightning or power surges, viruses, software changes, or repairs or tampering by anyone else. A repair warranty covers only the fault repaired, not other faults that appear later.

4. Uncollected devices

  1. We will notify the customer by SMS, WhatsApp or e-mail when a device is ready, or when a quote is declined and the device must be collected.
  2. Devices must be collected within 30 days of that notice. After 30 days, a storage fee of R150 per month may be charged.
  3. If a device is not collected within 3 months of the notice, and we have sent a final written notice to the last contact details given, ACT Computers may sell or dispose of the device to recover the amounts owed. Any money left over after the amount owed will be kept for the customer to claim.
  4. Devices are only handed over to the person who booked them in, or someone with the job card and written permission.

5. Sales

  1. Prices include VAT and are valid on the date of the quote or invoice. Quotes are valid for 7 days, as supplier prices and exchange rates change often.
  2. Payment is due before goods or repaired devices are released, unless an account has been approved in writing.
  3. Ownership. Goods remain the property of ACT Computers until paid in full.
  4. Special orders. Items ordered specially for a customer may need a deposit. If the customer cancels a special order, a reasonable cancellation fee may be deducted from the deposit, covering costs we cannot recover from the supplier.
  5. Returns. Goods can be returned under the warranty in section 3. Goods bought online or by phone may also be returned within 7 days of delivery under the Electronic Communications and Transactions Act, unused and in their original packaging.
  6. Software and licences. Software, Microsoft and other licences, and cloud subscriptions cannot be returned or refunded once the licence key has been issued or activated, unless the product is defective.

6. Call-outs and on-site work

  1. Call-outs are available Monday to Friday 08:00 to 18:00 and Saturday 08:00 to 12:00.
  2. A call-out fee, travel charge and labour rate apply as quoted when the call-out is booked. Travel outside Kroonstad is charged per kilometre.
  3. Labour is charged from arrival on site, in the units stated on the quote.
  4. The customer must give safe access to the premises and equipment, and someone authorised must be present.
  5. A call-out cancelled less than 2 hours before the booked time, or where we cannot get access, may be charged as a completed call-out.

7. Monthly services

This section covers monthly services such as Acronis cloud backup, VPN, maintenance and service level agreements (SLAs), and bulk mail.

  1. Term. Monthly services run month to month and either party may cancel with one calendar month’s written notice, unless a signed quote or SLA states a different term.
  2. Payment. Fees are payable monthly in advance. If payment is late, we may suspend the service until the account is paid.
  3. Cloud backup. We provide the backup service, but the customer must check that backups complete and that important data can be restored. ACT Computers is not liable for data that was never backed up, or for loss caused by the customer’s actions or by events outside our control.
  4. Data after cancellation. Backup data is deleted 30 days after a service is cancelled. The customer must make their own copy before then.
  5. Maintenance agreements and SLAs cover only the equipment and response times listed in the signed agreement.

8. Liability, privacy and general

  1. Liability. ACT Computers is not liable for indirect or consequential loss, such as loss of income, profit or data, except where caused by our gross negligence or where the CPA does not allow such a limit.
  2. Non-payment. Overdue amounts may be handed over for collection, and the customer will be liable for reasonable collection and legal costs.
  3. Privacy. Personal information is handled according to the shared Privacy Policy on www.act.co.za.
  4. Notices. We may send notices by SMS, WhatsApp or e-mail to the contact details the customer gave us.
  5. Law and courts. South African law applies. The customer consents to the jurisdiction of the Magistrate’s Court.
  6. Changes. We may update these terms. The version on www.act.co.za on the date of the sale, repair booking or service order applies.
